1. Who we are
These terms apply to every purchase in this shop, including shops that carry the name and style of a partner. The seller is always WeBellen B.V., trading as eSIMMY, J.J. Viottastraat 35, 1071 JP Amsterdam, the Netherlands, Chamber of Commerce no. 78174929, VAT no. NL861290641B01, email support@esimmy.com.
2. What you buy
You buy a data-only eSIM or extra data for an eSIM you already have ("top-up"). Each bundle has a data allowance, a validity period and a coverage area, shown before you pay. The eSIM does not include a phone number for calls or text messages.
The eSIM connects to local partner networks. Speed and coverage depend on those networks and on your location; we cannot guarantee a specific network or speed.
3. Your phone
You are responsible for making sure your phone supports eSIM and is not locked to a carrier. An eSIM profile can usually be installed only once. If you delete it from your phone, it may not be possible to reinstall it.
4. Prices and payment
Prices are shown in the currency you choose and include any VAT that applies. Payment is handled by Stripe. [Check VAT/OSS treatment per customer country.]
5. Delivery
After payment we deliver the eSIM digitally: by email and on the confirmation page. A top-up is added to your existing eSIM; you don't need to install anything. If delivery is delayed, we retry automatically and contact you if needed.
6. Validity and use
Your validity period starts when the eSIM first uses data on a network, not when you buy it and not when you install it. So you can buy and install before you travel without losing days. If you add a top-up while a bundle is still running, the top-up waits its turn and only starts when the current bundle ends. Unused data expires at the end of the validity period and is not refunded. Hotspot use is allowed. Use that harms the network or breaks the law is not allowed and may lead to suspension.
7. Right of withdrawal
Because the eSIM is digital content delivered immediately, you ask us at checkout to deliver right away and you acknowledge that your right of withdrawal ends once the eSIM has been delivered. If we cannot deliver a working eSIM, you are entitled to a refund.
8. Refunds and complaints
Does your eSIM not work and can we not solve it together? Contact us within 14 days of purchase at support@esimmy.com. A refunded eSIM is deactivated.
What you get back depends on what went wrong:
- It never worked and we could not fix it: the full price back.
- It worked for part of your trip and then failed through no fault of yours: a proportional refund for the part you could not use.
- It works but you changed your mind: no refund. The eSIM was delivered the moment you paid, and your right of withdrawal ended there.
We decide within five working days of your report. After that it takes another five to ten working days for your bank to show the money, which is their timing, not ours.
9. Liability
We are liable only for direct damage. Direct damage means: reasonable costs to establish the cause and extent of the damage, reasonable costs to make our performance conform to the agreement, and reasonable costs to prevent or limit damage, insofar as you show that those costs actually limited direct damage.
We are not liable for indirect damage, including consequential loss, lost profit and missed connections or bookings — except where that damage is due to our intent or gross negligence. Nothing in these terms excludes our liability for death or personal injury.
Report any claim to us in writing as soon as you become aware of the damage, so that we can still investigate what happened.
We are not liable for damage caused by incorrect or incomplete information you gave us, or by use of the eSIM that does not follow these terms or the installation instructions.
10. Partner shops
If you buy through a shop in a partner's name, we remain the seller and are responsible for payment, delivery and support. The partner may receive a commission; this does not change your price.
11. Law
Dutch law applies. If you live in the EU, the consumer protection of your own country still applies. If we cannot resolve a complaint together, you can bring it before the competent court.
